The order bans executive branch officials from signing nondisclosure agreements for data centre projects and requires a review of backup-generation operations used by data
The order also establishes an AI task force responsible for evaluating how the state government can address risks to Virginians like workplace safety, environmental impacts and the strain on local infrastructure. Spanberger's move comes as the state grapples with a boom in hyperscale facilities, which have drawn criticism for noise, pollution and the loss of local control. The executive action signals a shift toward stricter oversight in a region that has previously prioritised rapid infrastructure growth.
The order requires expedited noise regulations and a review of backup-generation operations, which are often diesel-powered and can contribute to local air quality issues. By prohibiting NDAs for data centre projects, the state aims to increase transparency around environmental and safety impacts. This approach contrasts with federal efforts to deregulate AI infrastructure, which have focused on removing environmental barriers to construction.
